End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (either an individual or a single entity) and Bane Collective (“Company”) for the software products and services provided by Company, including mobile applications and enterprise automation tools.

By installing, copying, or otherwise using the software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the software.

Section 1: License Grant & Scope

1.1 Mobile Applications

Company grants you a personal, non-transferable, non-exclusive license to download, install, and use Bane Collective mobile applications on compatible electronic devices owned or controlled by you, strictly for your personal or internal business use.

1.2 Enterprise Automation Services (Collective Neural Inbox)Company grants you a non-exclusive, non-transferable right to access and use the Collective Neural Inbox (CNI) platform and its associated dashboard interface via a secure web browser configuration solely for your internal business operations.

Section 2: User Restrictions

You agree that you will not, and will not permit any third party to:

  • Reverse engineer, decompile, or disassemble the software or attempt to derive the source code of any Bane Collective product.
  • Modify, adapt, or create derivative works based upon the software or dashboard infrastructure.
  • Rent, lease, loan, resell, or distribute access to the services to any unauthorized third party.
  • Use the automated webhook infrastructure or processing endpoints to transmit spam, malicious code, or illegal content.

Section 3: Data Usage, Accuracy & AI Limitations

3.1 Collective Neural Inbox Data Processing

  • By enabling inbound email forwarding to the CNI platform, you grant Company a temporary license to process, parse, and analyze inbound email text bodies solely to execute the dashboard features and automated response drafting functions.

3.2 AI Limitation of Liability

  • You explicitly acknowledge that the CNI platform utilizes Large Language Models (LLMs) via secure developer API routing to categorize and summarize inbound communications.
  • Review Requirement: You agree that all AI-generated summaries, classification tags, and automated text drafts must be reviewed and approved by a human operator before taking critical business or legal actions.
  • Accuracy: Company makes no guarantees regarding the 100% factual accuracy, nuance comprehension, or contextual perfectness of the AI extraction layers.

Section 4: Disclaimer of Warranties & Limitation of Liability

4.1 “As Is” Warranty

  • The software and automation services are provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied. Company does not warrant that the operation of the software or email webhooks will be uninterrupted, completely secure, or error-free.

4.2 Limitation of Damages

  • To the maximum extent permitted by applicable law, in no event shall Bane Collective be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of confidential or business data, business interruption, or loss of privacy) arising out of or in any way related to the use of or inability to use the software or automation pipelines.

Section 5: Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts located in Howard County, Maryland.

Section 6: Subscription Tiers & Fair Use

Hobby Hoard offers multiple levels of service to manage your craft inventory:

  • Free Tier: Limited to ten (10) total items in your hoard.
  •  $4.99 Plus pack, $2.99/mo Pro, $19.99/yr Pro Annual
  • Base App ($9.99 One-Time): Unlocks unlimited item storage and manual entry features.
  • Pro Tier ($2.99/Month): Unlocks the “Smart Scanner” (automated data retrieval). It will unlock 20 daily scans.
  • Pro Annual Tier ($24.99/year): “Smart Scanner” yearly subscription at a discount. It will unlock 20 daily scans
  • Plus Pack ($4.99): 100 extra scans that never expire.

Fair Use Policy for Smart Scanner:

  • Database Lookups: There is no limit on scans for items already stored in the Hobby Hoard community database.
  • External API Lookups: Automated data retrieval from external global databases is limited to 20 unique scans per 24-hour period per Pro account.
  • Manual Fallback: Once the daily limit is reached, users may continue to add unlimited items using the Manual Entry feature. Limits reset daily at 12:00 AM UTC.

6.1. Payments & Cancellations

All sales are handled via Stripe.

  • Subscriptions: All subscriptions are handled via Stripe.
  • Refunds: All sales handled via Stripe are subject to their respective refund policies. For website purchases, please contact support.

6.2. Intellectual Property & Data Contributions

  • While you retain ownership of your specific inventory lists, the compiled “Master UPC Data” database is the exclusive property of Hobby Hoard. By manually entering or correcting product data, you grant Hobby Hoard a perpetual, worldwide license to use that specific product information (brand, name, category) to improve the community database. No personal user data is ever shared in this process.

6.3. Account Termination & Deletion

  • You may delete your account and all associated “Hoard Data” at any time via the App settings or by contacting support. 

6.4. Support, Warranty, and Claims

  • Hobby Hoard is solely responsible for providing maintenance and support. The app is provided “as is” with no warranty. Hobby Hoard, not Apple or Google, is responsible for addressing any claims relating to the app, including product liability or intellectual property infringement.

6.5. Legal Compliance

  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
